Welcome to Betfair. We offer you a global portfolio of gambling products and services.

Account

If you wish to bet, or to play games for real money, you will need to open an account with us. By opening an account with us, you agree to be bound by our Account Terms and Conditions of Use. Betting

Before beginning to bet, you should read through our Betting – General Conditions as well as the “Specific Conditions” which apply to you and to each of your betting transactions as set out below.

By entering into any betting transactions on our site, you agree to be bound by both the Betting – General Conditions and the specific conditions applicable to that particular betting transaction:

Gaming

Before playing Betfair Poker, Betfair Casino or other games with us, you should read through our Betfair Gaming – Conditions of Use. By playing any of these games, you will be deemed to have registered with the relevant Betfair entity that supplies the games to you (as set out in the Betfair Gaming – Conditions of Use).

By playing the games or any of them, you agree to be bound by our Conditions of use.

Part B – Account Terms and Conditions of use

Welcome to Betfair. Before you can use our services, you need to open an account and deposit funds.

Please read these Terms and Conditions carefully before opening an account with us.

Please also read our Privacy Policy, Cookie Policy, Dispute Resolution Policy, Trust Deed and the provisions regarding the Betfair Charges which are incorporated by reference into these Terms and Conditions. If there is any inconsistency between these Terms and Conditions and any of the documents listed above, these Terms and Conditions will prevail.

By clicking the “I Confirm” button on the account opening screen, you agree to be bound by these Terms and Conditions.

If you reside in the UK, you will be opening an account with TSE Malta LP, and references in these Terms and Conditions to “Betfair”, “we”, “us” or “our” will be to TSE Malta LP. TSE Malta LP is licensed and regulated by the Gambling Commission in Great Britain.

If you reside in Australia or New Zealand, you will be opening an account with Betfair Pty Limited and references in these Terms and Conditions to “Betfair”, “we”, “us” or “our” will be to Betfair Pty Limited. Betfair Pty Limited is licensed and regulated by the Northern Territory Racing Commission. Betfair Pty Limited is the holder of a betting exchange licence issued under the Racing and Betting Act 1983 (NT).

If you reside anywhere other than in the UK, Australia or New Zealand, you will be opening an account with Betfair International Plc, and references in these Terms and Conditions to “Betfair”, “we”, “us” or “our” will be to Betfair International Plc. Betfair International Plc is licensed and regulated by the Malta Gaming Authority, Malta. No: MGA/CL3/454/2008 (issued on 17th March 2010).

1. Your Account

In consideration of our accepting your application to open an account, you represent to us (and acknowledge that we rely on these representations) as follows:

• a. You are 18 years of age or over. It is an offence for anyone under the age of 18 to open an account or to gamble on Betfair;
• b. You are of sound mind and capable of taking responsibility for your own actions and that you can enter into a legally binding agreement with us;
• c. You agree to provide accurate registration information, including without limitation your correct date of birth and your country of residence. You agree to inform us of any changes in such details;
• d. You are the person whose details are provided in connection with your registration or, in the case of legal entities, you are a duly authorised representative of the relevant legal entity;
• e. You are acting as a principal and not as an agent on behalf of a third party;
• f. You are not an undischarged bankrupt or in a voluntary arrangement with your creditors;
• g. You are not located in a country where the use of our services is prohibited, for example the United States of America, Turkey or any other country with a comparable legal situation. You are entirely responsible for complying with your own local, national, federal, state or other laws concerning betting and gaming prior to opening an account, placing any bets or using our services;
• h. You are not currently subject to a self-exclusion from a Betfair or Paddy Power account and neither we nor any other operator has excluded you from gambling; and
• i. You will, following a request from us (which may be made at any time before or after you open an account with us), promptly provide any documentation or information which we request in order to evidence your identity, age, address, country of birth or authorisation to use a particular debit card (and you agree that we may perform checks in order to verify any such documentation or information).

It is your responsibility to keep your contact details up-to-date on your account. Failure to do so may result in you failing to receive important account related notifications and information from Betfair, including changes we make to Betfair’s terms and conditions.

You are solely responsible for the security and confidentiality of your account. In particular, you agree to keep your username, password and/or TAN strictly confidential and you are responsible for any misuse of your password and/or TAN. Please note that when you create an account you have the option to use your email address or a username to log in to/identify your account. This can reduce the security levels of your account as your email address may be more accessible and this makes it easier for third parties to gain access to your account.

Provided that we have been correctly supplied with the account information requested, we are entitled to assume that offers and payments are made by you. You should change your password on a regular basis and never disclose it to any third party. You undertake to protect your username and password in the same way that you would in respect of your bank cards and any failure to do so shall be at your sole risk and expense. If another person accesses your account, you are solely responsible for all their actions whether or not their access was authorised by you and you hereby indemnify us and hold us harmless against all costs, claims, expenses and damages howsoever arising in connection with the use of or access to your account by any third party.

You will not attempt to sell or otherwise transfer the benefit of your account to any third party and nor will you acquire or attempt to acquire an account which has been opened in the name of a third party.

2. Multiple accounts

From 31 January 2013, customers with an existing Betfair account are not permitted to open a new account with Betfair.

Any customer that already has more than one Betfair account on 31 January 2013 is required to nominate a single Betfair account to use across Betfair’s products by contacting the Betfair Helpdesk. Customers that continue to operate multiple Betfair accounts after 31 January 2013 will have their accounts “linked” and managed accordingly. This may affect the extent to which bets can be placed on the Betfair Sportsbook by such customers.

Should Betfair believe, using its absolute and sole discretion, that you have:

• a. registered and/or used more than one account; and/or
• b. acted in collusion with one or more other individuals through a number of different Betfair accounts to back the same combination of selections (regardless of whether or not such bets are struck separately, at a range of different prices or on different days)

in an attempt to exceed the maximum pay-out for an individual account holder across linked accounts, it reserves the right to withhold any winnings arising from such behaviour.

3. Deposit and withdrawal of Funds

To bet or to play games for money on Betfair, you need to deposit funds. Except as set out below, all funds in customer accounts are held by The Sporting Exchange (Clients) Limited, a group company established solely for the purpose of holding customer funds (the “Trustee”), under the terms of the Trust Deed (the “Trust Fund”). Holding your money in the Trust Fund has the following benefits to you:

• a. in the unlikely event that Betfair (or any other operating company within the Betfair group) becomes subject to any insolvency proceedings, then your money will not be available to administrators/liquidators (or similar) and so you will be able to withdraw your money from your account as normal;
• b. the law of equity (which governs this Trust Fund) provides additional remedies to all beneficiaries of the Trust Fund (i.e. to all Betfair customers) that may not otherwise exist in a contractual relationship (eg a duty to act in good faith); and
• c. we have a number of additional controls in place over the Trust Fund to protect your money. This arrangement meets the Gambling Commission’s requirements for the protection of customer funds at the level: high.

Your funds will not be held by the Trustee if: (i) there is a requirement for such funds to be held under the terms of any licence, in a separate non set-off bank account in the name of the licence holder; or (ii) where such funds are deposited via a third party payment provider (hereafter referred to as a “Payment Provider”). Funds deposited via a Payment Provider may take a few days before they are held by the Trustee under the terms of Trust Deed. During this period your funds will be held in the account of the relevant Payment Provider and will not be protected under the terms of the Trust Deed. Depositing by any method other than the following will be classed as a deposit via a third party Payment Provider: (a) bank transfer, (b) cheque and (d) debit card.

The funds in your account are held on your behalf by way of security to meet any payment obligations you may incur as a result of betting or playing games on our site or using any of the products or services supplied by Betfair. Details of the manner in which the Trust is operated are set out in the Trust Deed.

You undertake that:

• a. all money that you deposit in your account is untainted with any illegality and, in particular, does not originate from any illegal activity or source; and
• b. all payments made into your account are authorised and you will not attempt to reverse a payment made into your account or take any action which will cause such a payment to be reversed by a third party, in order to avoid any legitimate liability.

  You accept that all transactions may be checked to prevent money laundering and that any transactions made by you which Betfair deems suspicious, may be reported to the appropriate authorities.

  We have a number of controls and checks that take place before any withdrawal request is processed by Betfair. These checks are part of our ongoing commitment to maintaining the security of our customers’ funds. All withdrawals requests are therefore only processed after the expiry of a set period of time from the withdrawal request being made.

Privacy

The information that you send to us will be processed in accordance with our Privacy Policy.

You authorise us, at any time, to use any means that we consider necessary to verify your identity and creditworthiness with any third party providers of information.

You agree to indemnify us and hold us harmless in respect of the release of any personal (or other) data pursuant to our Privacy Policy.

You agree that, from time to time, we may contact you to ask if you would like to take part in promotional activity. We would only do this if you won a large amount of money on one of our products, or if you placed an unusual bet which was successful. If you agree to take part in such promotional activity, we may use your name and/or your image as reasonably required.

Indemnity

You acknowledge that Betfair and its affiliates will hold information with respect to your identity, including but not limited to your name, address and payment details. You agree that we rely on this information in entering into our agreement with you and you agree to hold us harmless against any falsehood or inaccuracy contained in the information you provide us.

Errors and Omissions

You will inform us as soon as you become aware of any errors with respect to your account and you will forfeit any amounts shown to be in your account that result from human error or technical fault.

Suspension or termination

Either we or you may suspend or terminate your account at any time, either with or without cause, upon notice (we will use our reasonable endeavours to give such notice to you either before or after suspending or terminating your account). Please contact the Betfair Helpdesk if you would like to close your account.

We may take steps to block you from betting on or using our site (or any part of it) if you are located in certain jurisdictions, for example the United States of America.

Following termination or suspension of your account, the Trustee will, in the normal course of events, return any funds in your account to you in accordance with the Trust Deed. Please contact the Betfair Helpdesk to recover any funds held in suspended or closed accounts.

However, we reserve the right to notify the Trustee to withhold the funds in your account from you pending the determination of any investigation (including any relevant external investigation) where:

• a. we suspect you have acted in breach of these Terms and Conditions or any other agreement relevant to your activities on our site, including where we suspect the account has been linked with fraudulent or dishonest activity; and/or
• b. we have to notify the Trustee to withhold the funds in your account by law or to comply with any advice, request or instruction from any governmental, regulatory or enforcement authority.

Following the determination of any such investigation we reserve the right to seize some or all of the funds in your account (by notifying the Trustee that the funds in your account should be released to us) if we are satisfied that you have acted in breach of these Terms and Conditions or any other agreement relevant to your activities on our site. We will deal with any funds obtained by us in this manner at our sole and absolute discretion and/or in accordance with any advice, request or instruction from any governmental, regulatory or enforcement authority.

In addition, if formally requested by the police, gambling regulators or taxation or other authorities or in the event that you fail to provide us with sufficient information to identify yourself in accordance with our own internal procedures or those imposed on us by regulatory authorities (wherever based) we may suspend your account and all functionality relating to the use of your account (e.g. bet management and withdrawal of funds) and notify the Trustee to withhold from you any funds in your account pending determination of any criminal or other legal proceedings or investigation to which such a request may relate or until you provide the necessary ‘know your client’ or ‘age verification’ information as appropriate.

For the avoidance of doubt at no point during any such period will interest accrue to you on any funds in your account.

For all customers other than customers of Betfair Pty Limited (“Australasian Customers”) and UK registered customers, if you do not use your account for a continuous period of 30 months, any funds remaining in your account may be forfeited to the Malta Gaming Authority pursuant to Maltese gaming regulations. Responsible Gambling

Betfair provides a self-exclusion facility to help you if you consider that you need to control your gambling. For information on responsible gambling, please click here.

If you request a self-exclusion, we will, as soon as is reasonably practicable, apply best practices to prevent you from using your account indefinitely. To this end, we may retain such personal data as is necessary (and for as long as is necessary which may be indefinitely) to implement the facility as effectively as possible (including for example your name, address and debit card details).

Our self-exclusion facility involves a joint commitment between Betfair and you. During a period of self-exclusion, we will take reasonable steps to prevent you re-opening your Account or opening a new Account but you must not attempt to re-open your Account or to try and open new Accounts.

You agree that you will not access any other Betfair account to use any of our services or products from which you have excluded, during the period of any such self-exclusion. You agree that: (i) if you hold accounts with both Betfair and Paddy Power and have self-excluded from an account on either site, you will not access any account which you hold on the other site (and we reserve the right to prevent you from attempting to access such other site) and (ii) if you hold an account with either Betfair or Paddy Power and have self-excluded from either site, you will not attempt to register an account with the other site during your period of self-exclusion (and we reserve the right to prevent you from registering an account with such other site).

Self-excluding from Betfair will not affect your marketing preferences with third parties, including with advertising websites or other third party affiliates. We strongly recommend that you also contact such third parties and opt out from receiving any gambling related communications from them.

To activate our self-exclusion facility, please contact our customer services.

With effect from 30 December 2016, if you apply a self-exclusion to your Betfair account, we will also try to prevent you from accessing any account which you hold with Paddy Power (for the same period of self-exclusion that applies to your Betfair account). However, there may be circumstances (including where we are unable to link your Betfair account to your Paddy Power account) where we are unable to do so. For certainty, we therefore recommend that, where you apply a self-exclusion to your Betfair account, you also do so to your Paddy Power account (and any other online account which you hold).

Please note that, if you applied a self-exclusion to your Betfair account before 30 December 2016, we will not automatically take steps to apply that self-exclusion to your Paddy Power account. In these circumstances, we recommend that you separately seek a self-exclusion to your Paddy Power account (and any other online account which you hold). If you applied a self-exclusion to your Betfair account before 30 December 2016 and also wish to self-exclude from your Paddy Power account, you can do so via your online Paddy Power account or, alternatively, by contacting our customer services.

If you request to self-exclude by using GAMSTOP, based on the information that you have provided to GAMSTOP, we will take reasonable steps to prevent you from transacting on your Betfair account, as soon as is reasonably practicable, following your self-exclusion being registered with GAMSTOP. However, there may be circumstances where we are unable to do so – these circumstances may include, but are not limited to; (1) where we are unable to match your Betfair account with the details that you provided to GAMSTOP; and (2) where there is a technical failure in the operation of GAMSTOP and we are unable to access the most up to date self-exclusion information. If you apply any player protection tools (e.g. Deposit Limit, Product Exclusion, Reality Check, Loss Limit) to your Betfair account, we will not take steps to apply the same player protection tool(s) to your Paddy Power account and we recommend that you separately seek to apply those player protection tools (or their equivalent) to any other online account which you hold (including your Paddy Power account). You will inform us as soon as you become aware of any errors in respect of your self-exclusion or any player protection mechanisms we make available to you. If you do not inform us when you become aware of such errors, then we shall not be liable for any losses which you may suffer.

We shall not be liable for any losses you or any third party may suffer if you circumvent our self-exclusion procedures and continue to use our products or services or if you continue to gamble with any third party.

Assignment

You may not assign these Terms and Conditions to any third party. Betfair may assign, transfer or novate any or all of its rights and obligations under these Terms and Conditions to any third party at any time without notice to you.

Severability

In the event that any provision of these Terms and Conditions is deemed by any competent authority to be unenforceable or invalid, the relevant provision shall be modified to allow it to be enforced in line with the intention of the original text to the fullest extent permitted by applicable law. The validity and enforceability of the remaining provisions of these Terms and Conditions shall not be affected.

Any provision of these Terms and Conditions that is invalid, illegal or unenforceable in any jurisdiction will be ineffective in that particular jurisdiction, without affecting the validity, legality or enforceability of that provision in other jurisdictions.

Dispute resolution

In the event of a dispute arising between us and you, we each agree to follow the procedure set out in our Dispute Resolution policy as amended from time to time.

Amendments

We reserve the right to make immaterial changes to these Terms and Conditions at any time. In relation to material changes, we will give you prior notice and/or to obtain your prior consent before making such changes and your continued use of the site will be deemed to be your acceptance of any material changes.

Communications and notices

Communications and notices to be given by you to us under these Terms and Conditions should be provided to us as set out in the Contact us section.

Governing Law and Jurisdiction

If you reside in the UK:

• a. these Terms and Conditions will be governed by the laws of England;
• b. and the courts of England have non-exclusive jurisdiction in relation to all disputes under these Terms and Conditions.

If you reside in Australia or New Zealand:

• a. these Terms and Conditions will be governed by the laws of the Northern Territory; and
• b. you agree to submit to the non-exclusive jurisdiction of the courts of Australia in relation to all disputes under these Terms and Conditions.

If you reside anywhere other than the UK, Australia or New Zealand:

• a. these Terms and Conditions will be governed by the laws of Malta;
• b. by accepting these Terms and Conditions, you agree to submit to the exclusive jurisdiction of the location that Betfair determines in its sole discretion, in respect of any disputes arising out of, or connected with, these Terms and Conditions;
• c. nothing in this paragraph shall prevent Betfair from applying to the courts of any jurisdiction for such provisional or protective measures as are available under the laws of that jurisdiction; and
• d. the rights and obligations under these Terms and Conditions shall not be governed by the United Nations Convention on Contracts for the International Sale of Goods and/or any local implementing legislation, the application of which is expressly excluded.

English Version

These Terms and Conditions have been prepared in various languages other than English for reference only. In the event of any differences between the English version of these Terms and Conditions and any non-English versions, the English version shall prevail.

• *Australasian events are identified on our site by an Australian flag and generally mean an event that takes place in Australia

Section 1: Betting – General Conditions

Betfair provides a platform upon which you can enter into various betting transactions in relation to the markets available on our site (“Markets”).

Where customers bet with each other on the Exchange, Betfair solely acts as a facilitator and does not act as a counterparty. However, Betfair may act as a counterparty but only for wagers between Australasian Customers. Betfair also offers Tote bets, as well as singles (which we call “˜Fixed Odds”) and “Multiples” bets at odds fixed by us.

You can enter into betting transactions either:

• a. on our site or through our apps (together the “Website Service”);
• b. by telephone (the “Telephone Service”); or
• c. by the Application Programs Interface (“API”).

Please note that not all Betfair betting products are available through each of the betting channels set out above.

In these General Conditions when we refer to “the Services” we mean all the services listed above (where applicable).

In these General Conditions references to “Betfair”, “we”, “us” and/or “our” are to whichever Betfair group company is providing the Services to you as set out in the Specific Conditions applicable to your betting transaction.

Please read these General Conditions, and the Specific Conditions applicable to you and your betting transaction carefully before entering into any betting transactions. Please also read our Exchange Rules and Regulations, Sportsbook Rules and Regulations, Privacy Policy, Cookie Policy, Dispute Resolution Policy, Trust Deed and the provisions regarding the Betfair Charges. All of these documents are incorporated by reference and form part of these General Conditions.

Please note that there are separate Rules and Regulations for each of our Exchange and Sportsbook products. The rules governing how markets are offered, managed and/or settled are not the same for every market on each product. In certain circumstances, a bet that is settled as a winner on one product may be settled as a loser on the other product (and vice versa). Additionally, different settlement rules may apply so that, for example, bets that are a winner on one product may be settled as a dead heat or be voided on the other product. Customers must ensure that they familiarise themselves with the relevant rules that apply to the bets that they place on Betfair’s products. If there is any inconsistency between the documents listed above, this document and the relevant Specific Conditions, the Specific Conditions will prevail over this document which will prevail over the documents listed above.

By entering into any betting transactions, you agree to be bound by these General Conditions and the Specific Conditions relevant to your betting transaction (together “the Agreement”).

When you place a bet on the Betfair Sportsbook, you are betting directly with PPB Counterparty Services Limited. By placing a bet on the Betfair Sportsbook, you will be deemed to have registered with PPB Counterparty Services Limited.

Conditions relating to your use of the services

1. Licence to use our site

Betfair grants you a limited licence to access our site provided that you comply with this Agreement.

The availability of our site does not constitute an offer or invitation by Betfair to use the site in any jurisdiction in which such use is illegal.

Your use of our site or any data feeds we may provide to you confers no rights whatsoever to the content and related intellectual property rights contained on our site or on any such data feeds. You agree not to monitor, use or copy our web pages or any of our web content, including without limitation any price data. You will not attempt to hack, make unauthorised alterations or introduce any kind of malicious code to the site by any means. You will not (a) reverse engineer or decompile (whether in whole or in part) any software available through the site; or (b) make copies, modify, reproduce, transmit, alter or distribute all or any part of the site or any material or information contained on it. Any unauthorised use or reproduction may be prosecuted.

2. Use of our Services

You understand that you may lose money on bets placed and accept that you are fully responsible for any such loss. You accept that under no circumstances will any amounts lost by you under any bet be recoverable from us.

It is your responsibility to verify that you are permitted to bet with us according to the jurisdiction of your domicile or habitual residence and/or in which you are located and you agree that you will not bet with us while you are located in a jurisdiction which prohibits you from betting with us. In particular, you will not bet or attempt to bet with us if you are located in the United States of America or in any other country with a comparable legal situation. These countries will be determined by Betfair from time to time. You undertake to use our services for legitimate betting purposes only. In particular you undertake not to

• i. engage in any activity which has the purpose or effect of causing damage to or in any way hindering our business operations or generating or increasing a liability on us, including without limitation any tax, levy or duty collecting authority;
• ii. bet on, or manipulate any individual Market in a manner which we believe has the purpose or effect of adversely affecting the integrity of the Exchange or any Market;
• iii. transmit information that assists in the placing of bets or wagers on any sporting event or contest from any territory where it is illegal to do so; and/ or
• iv. procure or otherwise arrange, whether directly or indirectly, for a third party to transmit information that assists in the placing of bets or wagers on any sporting event or contest from any territory where it is illegal to do so.

3. Your Conduct

You will not attempt to use the Exchange to deliberately transfer money from one Betfair account to another by attempting to match bets on a Market with another account through collusion. You will inform us as soon as you become aware of any errors in calculations with respect to any betting transaction. We reserve the right to declare null and void any bets which are the subject of such an error.

You will not disguise or interfere in any way with the IP address of the computer you are using to access the site or otherwise take steps to prevent us from correctly identifying the actual IP address of the computer you are using whilst accessing the site.

You agree it is your responsibility to account for any tax or duty imposed on you as a result of any of your betting transactions. You will not make offensive comments, use offensive or pornographic material or make potentially defamatory or inflammatory remarks in connection with the forums or any other part of our site including within your own username or other information contributed to our site.

4. Privacy

Any information you send to us will be processed in accordance with our Privacy Policy.

You authorise us, at any time, to use any means that we consider necessary to verify your identity and creditworthiness with any third party providers of information. If you are an Australasian Customer, you consent to have your identity verified using data information sourced on behalf of us by Veda Advantage Limited (or such other third party that we may use from time to time).

We reserve the right to record ALL telephone calls to and from Betfair and to monitor all information relating to betting activities for which purposes you consent in accordance with the requirements of the Regulation of Investigatory Powers Act 2000 and such other legislation as may be applicable. You agree to indemnify us and hold us harmless in respect of the release of any personal (or other) data pursuant to this Agreement.

Conditions relating to betting

5. Operation of our Services

You are responsible for understanding the contents of our site and the operation of the Services and we reserve the right to change the format of the Services in order to enhance such Services.

We may determine when the Markets are open for betting and may close the Markets at any time in our absolute discretion. Though we will at all times use reasonable endeavours to settle Markets as quickly as possible, we give no assurances as to the timeframe in which Markets will be settled.

You are entirely responsible for the information that you provide to us concerning the offer that you wish to place. We will not enquire into the reasonableness of any offer that you may make. We will not be liable for incorrect entries made by you, including data input errors with respect to the odds, price or stake on offer, or incorrect bet requests communicated by you to a Betfair Telephone Operator. If a Betfair Telephone Operator repeats back your bet request incorrectly, it is your responsibility to correct the bet request and inform the Betfair Telephone Operator of the error. Once you have confirmed the bet request to the Betfair Telephone Operator (whether or not that was the original bet that you requested) and your bet is matched, you will be liable for that bet if it loses.

Betfair may, in its sole and absolute discretion, decide to suspend betting on a Market at any time (even if such suspension is earlier than anticipated by our Exchange Rules and Regulations and/or Sportsbook Rules and Regulations). In the interests of maintaining integrity and fairness in the Markets, Betfair may also void certain bets in a market or void a whole Market in its entirety.

You should be aware that some customers make use of programs designed to automatically place bets within certain parameters set by them (e.g. to back or lay at a certain price) (“bots”). These bots may be active in any or all Markets at any time and you should not assume that you can place bets on quiet Markets that will not be automatically matched simply because the Market otherwise appears quiet. Additionally bot users should be aware that bots might be prone to exploitation by other customers.

6. Cancellation, Termination, Suspension and Breach

We may restrict your access to Betfair, suspend or terminate your account, withdraw your offers for bets, void any bets outstanding to your account, cancel any unmatched bets or cancel and void any outstanding or matched bets in our absolute discretion without cause at any time including if:

• i. there is a technological failure;
• ii. we suspect that you are engaging in illegal or fraudulent activity;
• iii. we suspect that you have (or may have) breached any part of this Agreement;
• iv. we suspect you are acting in a manner that is detrimental to the conduct of our business or which may result in legal liability for you, us or third parties;
• v. we suspect that your account’s “public market data” usage (‘public market data’ includes market prices, traded Volumes and market depth) could represent business usage (˜’business usage’ includes any use by a betting operator or any use by an individual or organisation supplying data or services to a betting operator);
• vi. we suspect that you may be having difficulties obtaining credit;
• vii. we have the right to do so as set out in our Exchange Rules and Regulations, Sportsbook Rules and Regulations;.
• viii. you are prohibited from entering into a bet by any term of your contract of employment or any rule of a sport governing body or other professional body which applies to you; or
• ix. you place a bet on any sporting match or event in which you take part (or in which a team of which you are a member, or in respect of which you are employed, takes part).

In relation to any cancelled or void bets, we reserve the right to notify the Trustee that any money in your account relating to these bets be paid to us in accordance with the Trust Deed or, if there are insufficient funds in your account, demand that you pay us the relevant outstanding amount relating to these bets.

7. Gambling by those under age

It is an offence for anyone under the age of 18 to open an account or to gamble on Betfair. If we identify that you are under 18 or were under 18 when you entered into any betting transactions on our site (“under age”):

• i. we will immediately prevent you from entering into any betting transactions or making any withdrawals from or use of your account;
• ii. we will investigate the claim that you are or were under age, including whether in fact you have been betting as an agent for or at the behest or on behalf of another person;
• iii. if we find that you are or were under age, we will notify the Trustee that all winnings which have accrued and remain in your account or which are otherwise due to be credited to your account should be paid to us in accordance with the Trust Deed;
• iv. we will return to you all stakes which were placed by you while you were under age.

8. Cancellation of an offer for a bet

You may cancel unmatched bets at any time either by:

1. requesting a cancellation of the relevant offer in the relevant section of the relevant Market on our site; or

2. by instructing a Betfair Telephone Operator to request a cancellation of the relevant offer.

Your cancellation of an unmatched bet becomes effective once we send you confirmation of the cancellation. In the event that your cancellation request is not received and processed in good time, you acknowledge that your offer may remain outstanding and available for acceptance.

You may not be able to cancel your offer if your bet has been partially or wholly accepted during the interval between your submitting your cancellation request and our confirming your cancellation. In this case, your original offer, or part thereof, will be validly accepted and the bet will be concluded.

When you amend an unmatched bet you are effectively cancelling that bet and submitting a new bet at the amended stake or odds.

We will cancel any offers for bets that remain outstanding at the time that we close a Market.

9. Minimum and maximum bet stakes

Depending on the product or type of market you are betting on and depending on the currency that you are betting in, there are minimum bet sizes that apply. These minimum bet sizes are subject to change and may differ depending on whether you are on our site or using the Telephone Betting Service. You are not permitted to place bets or try to place bets that are below the minimum bet size threshold and doing so may result in your account being permanently closed.

Your betting limit is represented by the lesser of: (i) your ‘Available to Bet’ balance shown in your account and (ii) your “Exposure Limit” (which is available in the “Account Summary” tab in “My Account”). However in the event that we process an offer for a bet or the acceptance of a bet in an amount outside the applicable thresholds, such bet will nevertheless stand.

10. Bet Settlement

Subject to these General Conditions and any applicable Specific Conditions we will settle Markets in accordance with our Exchange Rules and Regulations, Sportsbook Rules and Regulations. We reserve the right to reverse or amend settlement in the event of a Market being settled incorrectly. This may lead to amendments being made to your account to reflect changes in Market settlement and if there are insufficient funds in your account we may demand that you put funds into your account to address the outstanding balance.

Any amount of winnings or losses relating to your bets on a Market will be rounded to the nearest two decimal places. If the amount ends in 0.5 it will be rounded up.

11. Taking advantage of rounding off

You are not permitted to place bets or try to place bets which deliberately take advantage of Betfair rounding off to the nearest penny or cent. Any bets which seek to do so will be automatically cancelled.

Conditions relating to us

12. Commission and payment structure

We charge a commission calculated by reference to your net winnings on a Market. Your stakes for bets placed on the Exchange are therefore not relevant for the calculation of the commission you pay. In particular, these stakes do not represent remuneration for the Services in connection with the Exchange.

In certain specified circumstances, you may also incur certain other charges. Please refer to Betfair Charges in the About Us section which sets out in detail how all commission and charges are calculated.

We reserve the right to amend our policy as set out in Betfair Charges as amended from time to time.

We will calculate the amounts that you owe us and notify the Trustee accordingly. The Trustee will deduct such amounts from your account and will pay such amounts to us in accordance with the Trust Deed.

Any amounts owed to us will be rounded to the nearest two decimal places. If the amount ends in 0.5 it will be rounded up.

13. Matters beyond our reasonable control

Without prejudice to our obligations contained within the various laws and regulations of the jurisdictions where we are licensed, we are not liable for any loss or damage that you may suffer because of any: act of God; power cut; trade or labour dispute; act, failure or omission of any government or authority; obstruction or failure of telecommunication services; or any other delay or failure caused by a third party or otherwise outside of our control. In such an event, we reserve the right to cancel or suspend our services without incurring any liability. We are not liable for the failure of any equipment or software howsoever caused, wherever located or administered, or whether under our direct control or not, that may prevent the operation of the Services, impede the placing of offers for bets or the matching of bets, or prevent you from being able to contact us.

Please be aware that if you place a bet with the intention of subsequently placing a separate bet to reduce the liability incurred by the initial bet (including by using Betfair’s “Cash Out” functionality), there can never be a guarantee that the Services will be available at the point you wish to place the subsequent bet (this is the case regardless of whether or not the unavailability of the Services is due to a matter beyond our reasonable control).

We will not be liable for any failure to perform by a third party to our Agreement.

14. Indemnity

You agree to indemnify and hold us and our associated companies, affiliates, officers, directors, agents and employees harmless from any liabilities, claims, losses or demands made by any third party arising out of your breach of this Agreement (including documents incorporated by reference) or out of your violation of any law or the rights of any third party. You acknowledge that Betfair and its affiliates will hold information with respect to your identity, including but not limited to your name, address and payment details. You agree that we rely on this information in entering into this Agreement and you agree to hold us harmless against any falsehood or inaccuracy contained in the information you provide us.

15. Limitation of liability

We exclude all representations and warranties as to the satisfactory quality and/or fitness for its intended purpose and/or accuracy and completeness of the Services.

We will not be liable to you for any loss that you may incur as a result of misuse of your password, or in the case of the Telephone Service, of your telephone access number, and we accept no liability resulting from its unauthorised use, whether fraudulent or otherwise.

In no event will we, or any of our suppliers, accept any liability however arising for any losses you may incur as a result of using the Services. Under no circumstances will our liability under this Agreement or for breach of contract, tort, equity or otherwise exceed your exposure limit as specified in your account. Under no circumstances will we be liable for any indirect, special or consequential damages, loss of profits (direct or indirect) or the benefit of any bet arising from breach of contract, negligence, equitable duty (including for the avoidance of doubt in relation to any bet(s) or Market(s) voided by us) or other liability even if we had been advised of or known (or should have known) of the possibility of such damages or loss. Nothing in this Agreement excludes our liability with respect to death and personal injury resulting from our negligence, or that of our employees, agents or subcontractors.

16. Right of set off

We may at any time, without notice to you, notify the Trustee to set off any liability owed to us or to our customers by you, including (without limitation) in relation to any Betfair account in your name or which we believe to be under your control:

• a. against any funds held in another Betfair account in your name or which we believe to be under your control in accordance with the terms of the Trust Deed; and/ or
• b. against any liability that we determine that you have to us in pursuant to these Terms and Conditions, including (without limitation) pursuant to the Betfair Charges.

17. Intellectual property

The Sporting Exchange Limited (“TSEL”), part of the Betfair group of companies, is the owner of:

• a. all copyright and related rights in and to our site, including, without limitation, rights in databases and all rights in any price data and related content on our site except for certain third party rights (referred to below);
• b. all trade mark rights, whether registered or unregistered, in and to BETFAIR and the BETFAIR logo; and
• c. the domain name www.betfair.com which is our uniform resource locator (“URL”).

The following use of price data or any other data or content from our site or via the API or any other Betfair data from any other source (together, Betfair Data) is strictly prohibited without the specific prior written consent of TSEL:

1. commercial use by any person; and/or
2. any use for any purpose by a competitor of the Betfair group of companies, or an employee, contractor or agent of any such competitor (“Restricted Person”), provided always that Restricted Persons may place bets.

Screen scraping, web scraping or any other automated or manual collection of Betfair Data, for commercial or personal use, by any person is expressly prohibited.

Any unauthorised use of any of the above rights may result in prosecution or other action being taken against you.

You hereby assign to TSEL absolutely, any and all copyright and other intellectual property rights throughout the world in all media whether now known or hereafter developed, for the full period of copyright, including by way of present assignment of future copyright and all other rights whatsoever, in any offers for bets or bets placed by you on our site. Any data licensed to Betfair and/or TSEL from third parties is provided for use on our site only and may not be used for any commercial purposes without the consent of such third parties.

Conditions relating to other services

18. Information Services

From time to time Betfair may provide you with access to various information and content. This may include form data, results, video streaming, upcoming events, the times and dates of events, current scores, time elapsed, and other information relating to a sporting event. Such information may be supplied:

• a. via our site (including micro-sites and as part of any runner data and/or results service), the Telephone Betting Service, emails or any other means of communication; and/or
• b. via links to third party websites.

Such information is described in these Terms and Conditions collectively as the “Information”.

The Information is provided by Betfair or is sourced from a third party. Although some Information may be described as “live”, or it may be implied that such Information is “live”, you should be aware that this data may be subject to a time delay. The Information may also be inaccurate. You should also be aware that other Betfair customers may have access to pictures and/or data that is faster and/or more accurate than the Information. The Information is supplied “as is” and is provided for guidance only. To the fullest extent permitted by law, Betfair makes no representations or warranties of any kind, including but not limited to, the accuracy, quality, completeness or timeliness of the Information.

If you rely on the Information to place bets, you do so entirely at your own risk. Betfair shall not be liable for any action taken or not taken by you as a result of your reliance on the Information or for any loss or damage (direct or indirect) suffered by you as a result of your use of the Information.

Any links to third party websites do not constitute an endorsement by Betfair of any products or services available on such websites. You use such websites at your own risk and Betfair takes no responsibility for the content on, or use of, such websites.

19. Betfair Forum

From time to time Betfair may provide you with access to an online chat forum (the “Betfair Forum”). If you use the Betfair Forum you agree to be bound by the Betfair Forum Terms and Conditions. The Betfair Forum Terms and Conditions are incorporated into this Agreement by reference.

We shall not be liable to you for any defamatory postings made by you or in relation to you. You agree to indemnify Betfair against any and all loss suffered by Betfair or any of its affiliated companies as a result of any Betfair Forum posting made by you.

You grant Betfair an irrevocable and perpetual license to use or reproduce all forum postings posted by you for any purpose and in any jurisdiction whatsoever.

General Conditions

20. Assignment

You may not assign any part of this Agreement without Betfair’s written consent but Betfair may assign any or all of this Agreement to any third party at any time without notice to you.

21. Severability

In the event that any provision of this Agreement is deemed by any competent authority to be unenforceable or invalid, the relevant provision shall be modified to allow it to be enforced in line with the intention of the original text to the fullest extent permitted by applicable law. The validity and enforceability of the remaining provisions of this Agreement shall not be affected.

22. Dispute resolution

In the event of a dispute arising between us and you, we each agree to follow the procedure set out in our Dispute Resolution policy as amended from time to time.

23. Amendments

We reserve the right to make changes to our site and all guides and policies included on our site, including this Agreement at any time. You will be subject to the guides, policies, conditions and agreements in force at the time that your bets are matched. It is therefore your responsibility to check the guides, policies and this Agreement from time to time to ensure that you agree with them, and your continued use of the Services will be deemed to be your acceptance of any changes we may make.

24. Communications and notices

Communications and notices to be given by you to us under this Agreement (other than those exchanges of information occurring in the normal operation of the site) should be provided to us as set out in the Contact us section.

25. English language version

This Agreement has been prepared in various languages other than English for reference only. In the event of any differences between the English version of this Agreement and any non-English versions, the English version shall prevail.

26. Entire Agreement

This Agreement and the terms expressly incorporated into them constitute the entire and only agreement between the parties with regards to its subject matter and each party confirms that it has not been induced to accept this Agreement in reliance upon, nor has it been given, any warranty (including in particular any warranty as to merchantability, fitness for purpose or uninterrupted functionality), representation, statement, assurance, covenant, agreement, undertaking, indemnity or commitment of any nature whatsoever other than as are expressly set out in this Agreement and, to the extent that it has been, it unconditionally and irrevocably waives any claims, rights or remedies which it might otherwise have had in relation thereto.

27. No waiver

No failure or delay by a party to exercise any of its rights under this Agreement shall operate as a waiver thereof and no single or partial exercise of any such right shall prevent any other or further exercise of that or any other right.

28. Governing Law and Jurisdiction

This Agreement is governed by the laws of and subject to the jurisdiction of the courts of the country set out in the “Governing Law and Jurisdiction” clause of the relevant Specific Conditions applicable to your particular betting transaction.

Section 2: Specific Conditions for customers betting on the Exchange other than Australasian Customers

UK Customers: TSE Malta LP (“Betfair”) provides an exchange upon which our UK registered customers can bet with each other (the “Exchange”) on the various markets available on our site (“Markets”).

Non UK Customers: Betfair International Plc (“Betfair”) provides an exchange upon which our non UK customers can bet with each other on the markets available on our site (“Markets”). Please read these Specific Conditions and the General Conditions carefully, before making any offers for bets or accepting any bets on the Exchange. If you are a UK registered customer and your betting transaction is covered by these Specific Conditions, references to “Betfair”, “we”, “us” and/or “our” in these Specific Conditions and in the General Conditions are to TSE Malta LP.

If you are a non UK customer and your betting transaction is covered by these Specific Conditions, references to “Betfair”, “we”, “us” and/or “our” in these Specific Conditions and in the General Conditions are to Betfair International Plc.

By entering into any betting transactions on the Exchange, you agree to be bound by these Specific Conditions as well as the General Conditions (together “the Agreement”).

Specific Conditions relating to your use of the Exchange

1. Your Conduct

You will at all times act in good faith in relation to the counterparties to your bets struck through the Exchange and such counterparties will be able to enforce this duty directly against you. In particular you will not place bets on the Exchange in breach of any sporting rules, regulations or code of conduct which apply to you.

2. Privacy

We may, at our sole and absolute discretion, provide you with details of any counterparty to your bets, only if we are satisfied that such counterparties have acted in breach of their duty of good faith. For this purpose, you explicitly consent to the release of your personal data in accordance with the UK Data Protection Act 1998, the Malta Data Protection Act 2001, the Gibraltar Data Protection Act 2004, the Australian Privacy Act 1988 and any other applicable laws.

Specific Conditions relating to betting on the Exchange

3. Operation of the Exchange

We reserve the right to refuse to post your offer on our Exchange without giving prior notice.

We may restrict you from using programs designed to automatically place bets within certain parameters (e.g. to back or lay at a certain price) (“bots”) either generally or in relation to any specific bot if we believe that you have used a bot:

• i. to the detriment of our business;
• ii. to place bets on, or manipulate, any Market which has the purpose or effect of adversely affecting the integrity of the Exchange or any Market.

You may not nominate individuals to be counterparties to any of your offers for bets.

We do not guarantee that every offer displayed as outstanding on our site (or communicated by a Betfair Telephone Operator as being outstanding) will be available for your acceptance. All or part of the offer of a bet displayed on our site or communicated by a Betfair Telephone Operator as available on the Exchange at specific odds or price may be successfully cancelled by one or more counterparties before your acceptance is processed by the Exchange (this risk is particularly relevant where you are using the Telephone Betting Service because your instruction will have to be read back to you before being sent to the Exchange, inevitably causing a further slight delay). In this case, the offer for a bet will be withdrawn before your acceptance of that offer is acknowledged. Your failed attempt to accept the bet formerly on offer will however be posted as an offer to other customers.

Betfair or its group companies may occasionally place bets on the Exchange. Such bets represent a tiny fraction of the overall volume of betting activity on the Exchange. We will typically place such bets in one of the following two circumstances:

• on less liquid markets to improve ‘˜liquidity’ and stimulate market activity (‘liquidity’ is the amount of money available for you to bet on each selection). We may do this on ancillary markets (particularly when the market is first made available) or on markets on less popular events. The rationale for providing this liquidity is to enhance the betting proposition for our customers; and
• in order to reduce the Betfair group’s liability against a particular outcome. We may do this on a high-profile event where our sportsbook has a very large exposure to that outcome.

If Betfair or its group companies place bets on the Exchange:

• they will only do so in accordance with Betfair’s terms and conditions and its relevant operating licences; and
• they will not have any advantage over other customers and they will place those bets in the same way that a normal customer would place them.

Employees of Betfair and its group companies are permitted to place bets on the Exchange. Such bets are placed in accordance with Betfair’s company policies. Employees have no advantage over other customers when placing bets and they place the bets in the same way that a normal customer would place them.

4. Best Price Execution

The Best Price Execution feature enables customers to get matched at the best available odds on the Exchange.

With the Best Price Execution feature switched on, if better odds are available, or become available, after you have placed your bet request, your bet will automatically be matched at the improved odds.

However, if the Best Price Execution feature is switched off, your bet will not be matched if better odds are available, or become available, after you have placed your bet request. Instead your bet request will lapse and you will be required to resubmit your bet at the improved odds.

The Best Price Execution feature is switched on by default for all customers and this is Betfair’s recommended setting. By using the Exchange, you agree that the Best Price Execution feature will be switched on by default. However, if you are resident in the UK and would like to disable the Best Price Execution feature, there is a toggle that allows you to switch it off at any time.

5. Cross-matching

In addition to only matching back bets against lay bets on the same selection, many markets on Betfair benefit from a process called ‘cross-selection matching’ and ‘cross-market matching’ to match bets (referred to collectively as ‘cross-matching’):

• Cross-selection matching: by using cross-selection matching, it may be possible for a bet request to be matched at a better price than could be achieved only by considering back bets and lay bets on the same selection, by also considering unmatched liquidity on the remaining selections in a market.
• Cross-market matching: some selections in a particular market are equivalent to one or more combinations of bets in other markets on the same event (for example, Match Odds, Asian Handicap, Correct Score and Total Goals markets). When using cross-market matching, it may be possible for a bet request to be matched at a better price than could be achieved only by considering back bets and lay bets on the same selection, by also considering unmatched liquidity on selections in other markets on the same event.

With the exception of bets placed at the ‘Betfair Starting Price’, bets on the Exchange can only be matched at prices that are a valid increment on Betfair’s odds ladder. This is the case whether it is simply a back bet matched against a lay bet or a bet that is matched by cross-matching. Where the bet is matched using cross-matching, the process will match the customer’s bet at the best price that is a valid increment on Betfair’s odds ladder.

In certain circumstances, because the cross-matching process can only match at prices that are a valid increment on Betfair’s odds ladder, this will result in Betfair generating a small amount of additional revenue from the cross-matched bet.

Bets will only be matched using the cross-matching process if that would result in a better price for the customer than matching their bet against an opposing bet on the same selection. Regardless of whether or not a bet is matched by cross-matching, where more than one unmatched bet at the same price could be used to match an incoming customer bet request, bets are always matched in the order in which they were received (i.e. first come, first served).

7. Governing Law and Jurisdiction

Insofar as UK registered customers are concerned, this Agreement is governed by the laws of England. Insofar as non UK customers are concerned, this agreement is governed by the laws of Malta. In both cases, the parties hereby submit to the non-exclusive jurisdiction of the courts of England in relation to all disputes under this Agreement.

Third parties do not have the ability to enforce any part of this Agreement save in respect of the rights of counterparties to enforce your duty of good faith directly against you. This Agreement, may however be varied at any time without the consent of any counterparties to any bets struck through the Exchange.

These Specific Conditions have been prepared in various languages other than English for reference only. In the event of any differences between the English version of these Specific Conditions and any non-English versions, the English version shall prevail.

8. Exceptional Circumstances

Whilst it is intended that the Exchange will operate under Betfair’s Gambling Commission licence for customers registered in the UK and under Betfair’s Maltese licence for non UK registered customers, we reserve the right at any time, including, without limitation, for disaster recovery purposes:

• v. to request that another Betfair group company, on its own account provides you with betting facilities; or
• vi. to assign this Agreement to another Betfair group company, in which case such other company will act as agent for, and provide services to us, to ensure that the Exchange will be available to you, subject to these Specific Conditions and the General Conditions.

Section 3: Specific Conditions for Australasian Customers

Betfair Pty Limited provides an exchange upon which our customers (being Australasian Customers) can make offers for bets and accept offers for bets (“the Exchange”).

Please read these Specific Conditions, and the Betting – General Conditions carefully, before betting on the Exchange.

If you and your betting transaction is covered by these Specific Conditions, references to “Betfair”, “we”, “us” and/or “our” in these Specific Conditions and in the General Conditions are to Betfair Pty Limited.

By entering into any betting transactions on the Exchange, you agree to be bound by these Specific Conditions as well as the General Conditions (together “the Agreement”).

Specific Conditions relating to your use of the Exchange

1. Your Conduct

You will at all times act in good faith in relation to the counterparties to your bets struck through the Exchange (including Betfair) and such counterparties will be able to enforce this duty directly against you. In particular you will not place bets on the Exchange in breach of any sporting rules, regulations or code of conduct which apply to you.

2. Operation of the Exchange

The Exchange carries offers for bets that remain available for acceptance by you at any time. The identity of the counterparty to your bet is dependent upon where you and other relevant customers reside.

We reserve the right to refuse to post your offer on our Exchange without giving prior notice.

We may restrict you from using programs designed to automatically place bets within certain parameters (e.g. to back or lay at a certain price) (“bots”) either generally or in relation to any specific bot if we believe that you have used a bot:

• i. to the detriment of our business;
• ii. to place bets on, or manipulate, any Market which has the purpose or effect of adversely affecting the integrity of the Exchange or any Market.

If we do so, we will take reasonable steps to bring this to your attention. In addition to the usual bet matching process, many markets on Betfair use a process called cross-selection matching (“cross-matching”) to match bets. When a bet request cannot be matched by an opposing bet on the same selection, cross-matching will attempt to match the bet request with unmatched liquidity on the remaining selections in the market.

We do not guarantee that every offer displayed as outstanding on our site (or communicated by a Betfair Telephone Operator as being outstanding) will be available for your acceptance. All or part of the offer of a bet displayed on our site or communicated by a Betfair Telephone Operator as available on the Exchange at specific odds or price may be successfully cancelled by one or more customers before your acceptance is processed by the Exchange (this risk is particularly relevant where you are using the Telephone Betting Service because your instruction will have to be read back to you before being sent to the Exchange, inevitably causing a further slight delay). In this case, the offer for a bet will be withdrawn before your acceptance of that offer is acknowledged. Your failed attempt to accept the bet formerly on offer will however be posted as an offer to other customers.

We will only allow you to place an offer on the Exchange if you are in compliance with these Terms and Conditions. If we allow you to make an offer for a bet and subsequently suspect that you are or were, at the time of making the offer, in breach of this Agreement, we may, at our absolute discretion, withdraw your offer from our Exchange, void any bets outstanding to your account and terminate your account.

Where you place both a back bet and a lay bet on the same selection at the same price, and your back bet is matched against your lay bet, Betfair will void the bet and no wagering transaction will arise.

Where you place both a back bet and a lay bet on the same selection at the same price, and your back bet and lay bet is matched against other customers, Betfair will void your bets and no wagering transactions will arise with you. In these circumstances, Betfair will match together the outstanding offers for bets made by the other customers.

3. Your Offers for Bets

Betfair acting as counterparty: Where your offer for a bet is matched in whole or in part by Betfair against the counter offer of another Australasian Customer, your offer, or a portion thereof to the extent that only part of it is matched against another Australasian Customer, will be accepted by Betfair as a counterparty in accordance with this Agreement.

Betfair acting as facilitator: Where your offer for a bet is matched in whole or in part against the counter offer of any other customer (i.e. other than an Australasian Customer), your offer, or a portion thereof to the extent that only part of it is matched against that customer, will be accepted by that other party in accordance with this Agreement. In these circumstances, Betfair acts solely as a facilitator and not as a counterparty.

Where Betfair acts as a counterparty:

• a. We may elect, in certain very limited circumstances, to nominate one or more of our affiliate or joint venture companies to accept your offers for bets and act as a counterparty in whole or in part in accordance with this Agreement
• b. An offer which you make for a bet is open for acceptance by us as a counterparty in whole or in part in accordance with these Terms and Conditions. We will only accept your offer for a bet to the extent that it can exactly match the risk to us of accepting your offer through one or more other customers who use our service contemporaneously accepting an offer by us in the same terms.
• c. You bet with us, not with other customers who use our service. We will post the details of your offer to us on our Exchange. An offer so posted on our Exchange also constitutes an offer by us to each of our other customers which may be accepted by them in accordance with the Terms and Conditions applicable to that customer. You offer to bet at the Odds or Price you select or at better Odds or a better Price, which may be higher or lower, depending on whether you are Backing, Laying, Selling or Buying an outcome, without increasing your exposure, if that is to your advantage.
• d. An offer for a bet that you make on the Exchange remains open for acceptance by us unless properly cancelled by you in accordance with Paragraph 8 of the Betting – General Conditions section.
• e. Your offer to us for a bet may be posted on the Exchange in isolation or in combination with other offers for bets on the same Market.

4. Our details

Betfair Pty Limited (“Betfair Australia”) is a limited liability company registered in Victoria with registered offices at Darwin Racecourse, Dick Ward Drive, Fannie Bay, Northern Territory 0820 (ACN 110 084 985). The Company is licensed in the Northern Territory of Australia.

Betfair Australia is licensed to operate the Exchange under Australian law. At any time the Exchange may be operated under a licence held by another company affiliated with Betfair Australia and if so Betfair Australia may assign this Agreement to such company.

Whilst it is intended that the Exchange will operate under Betfair Australia’s existing licence, we reserve the right to switch the operation of the Exchange to another jurisdiction at any time, including, without limitation, for disaster recovery purposes. In this case another company in an alternative jurisdiction will act as agent for, and provide services to Betfair Australia, to ensure that the Exchange will be available to you, subject to these Specific Conditions and the General Conditions.

5. Privacy

We may, at our sole and absolute discretion, provide you with details of any counterparty to your bets, only if we are satisfied that such counterparties have acted in breach of their duty of good faith. For this purpose, you explicitly consent to the release of your personal data in accordance with the UK Data Protection Act 1998, the Malta Data Protection Act 2001, the Gibraltar Data Protection Act 2004, the Australian Privacy Act 1988 and any other applicable laws.

6. Disclosures

Betfair guarantees the full settlement of all wagers matched where those bets or part thereof are matched by Betfair acting as a facilitator or an intermediary. Where any customer does not meet their obligations, Betfair will settle the wager in full.

There is no expiry date on the facility by which customers deposit funds into their accounts.

Governing law and jurisdiction

This Agreement is governed by the laws of the Northern Territory of Australia and the parties hereby submit to the non-exclusive jurisdiction of the courts of Australia. These Specific Conditions have been prepared in various languages other than English for reference only. In the event of any differences between the English version of these Specific Conditions and any non-English versions, the English version shall prevail.

Section 4: Specific Conditions for customers placing multiples bets

PPB Counterparty Services Limited enables you to make us offers for multiple bets, which we may or may not accept, on our site (“the Website Service”). Please read these Specific Conditions, and the General Conditions, carefully, before making any offers for multiple bets on our site.

If you and your betting transaction is covered by these Specific Conditions, references to “Betfair”, “we”, “us” and/or “our” in these Specific Conditions and in the General Conditions are to PPB Counterparty Services Limited. By entering into any betting transactions on our site, you agree to be bound by these Specific Conditions as well as the General Conditions (together “the Agreement”).

Specific Conditions relating to Multiples Betting

1. Making Of Bets

When you make a bet, you are betting with Betfair and not with other customers who use our site.

An offer which you make for a bet is open for acceptance by Betfair as a counterparty in whole or in part in accordance with these terms and conditions.

Once Betfair has accepted your offer, you will not be allowed to change the terms of that bet or cancel or withdraw from that bet. Acceptance of an offer by Betfair concludes the bet.

Notwithstanding any statement to the contrary in this Agreement, we may elect, in certain very limited circumstance, to nominate one or more of our affiliate or joint venture companies to accept your offers for bets. If we do so, we will take reasonable steps to bring this to your attention.

2. Bet Settlement

We are not liable for the settlement of any offers for bets if for any reason, we fail to process any instruction in good time.

Section 5: Specific Conditions for customers placing Tote bets

PPB Games Limited enables you to place Tote bets on our site (the “Website Service”). By placing Tote bets, you will be deemed to have registered with PPB Games Limited. Australasian Customers will not be able to place Tote bets.

Please read these Specific Conditions, and the General Conditions, carefully, before making any Tote bets on our site.

If you and your betting transaction is covered by these Specific Conditions, references to “Betfair”, “we”, “us” and/or “our” in these Specific Conditions and in the General Conditions are to PPB Games Limited.

By entering into any betting transactions on our site, you agree to be bound by these Specific Conditions as well as the General Conditions (together “the Agreement”).

Specific Conditions relating to Tote Betting

1. Counterparty to your Tote Bets

When you make a Tote bet, you are betting with Betfair as counterparty to your bet.

An offer which you make for a bet is open for acceptance by Betfair as a counterparty in whole or in part in accordance with this Agreement.

Notwithstanding any statement to the contrary in this Agreement, we may elect, in certain very limited circumstances, to nominate one or more of our affiliate or joint venture companies to accept your offers for bets.

2. Placing Tote Bets

Once you submit your Tote bet request to Betfair, we will deduct the appropriate stake from your Betfair account and we will then attempt to strike a corresponding bet into the relevant Tote pool (the “Corresponding Bet”). While we attempt to strike the Corresponding Bet, your bet request will be ‘Pending’ and you will not be allowed to change the terms of that bet or cancel or withdraw from that bet. However, please note, the deduction of the stake from your Betfair account does not signify the acceptance of your Tote bet.

The Corresponding Bet will usually be successfully placed within a couple of seconds . Once the Corresponding Bet has been placed, the Tote Betslip on your screen will show the status of the bet as ‘Bet placed’. It is only when the status of the bet is confirmed as ‘˜Bet placed’ that your bet is confirmed and accepted by Betfair.

In the unlikely event that Betfair is unable to successfully place the Corresponding Bet into the relevant Tote pool for any reason whatsoever (including the failure of Betfair’s systems), your Tote bet request will fail, your bet will not be accepted by Betfair and your Tote bet will not be placed. In other words, the acceptance of your Tote bet is entirely conditional on Betfair successfully placing the Corresponding Bet into the relevant Tote pool. Betfair will have no liability to you (including for any money you would have won) if it is not able to or if it fails to for any reason place the Corresponding Bet or it otherwise fails to process your bet request on time.

Please see paragraph 3 below for how to check the status of your Tote bet. Please note, unless the Tote Betslip updates after you have placed your Tote bet to show ‘˜Bet Placed’, you should ensure that you check the status of your bet within “My Account” to confirm whether or not your bet has been successfully placed.

3. Checking the status of your Tote Bets

To check whether your bet has been successfully placed, we advise you to go to the “Current Bets” tab within “My Account, click on the “Tote Bets” button and check the “Status” column to ensure that it shows “Bet placed” next to the relevant Tote bets. If the “Status” column shows “˜Bet not placed”, this means we have not been able to place the Corresponding Bet into the relevant Tote pool and your Tote bet has not been accepted by Betfair. If the “Status” column shows “Bet pending”, this means that we are still trying to place the Corresponding Bet into the relevant Tote pool and you should keep checking back to see whether or not your bet is placed.

Part D – Betfair Gaming – Conditions of use

The Betfair group of companies holds several gambling licences which enables us to offer a wide range of gambling products and services to customers globally in a fair and regulated manner. The type of game you wish to play will determine which Betfair group company will provide you with the platform and, where appropriate, software to play the game.

Betfair issue upgraded versions of the Software from time to time and will make such upgraded versions available to you. All such upgrades shall be deemed to be Software for the purposes of these Conditions.

3. Use of our site

You can only play the Games for money if you are:

• a. 18 years of age or over; and
• b. Have reached the age at which you are legally entitled to play the Games in whichever country you access our site.

It is your responsibility to verify that you are able to play the Games for money in the country in which you are accessing our site. If you are not so entitled, Betfair reserves the right to:

• iii. immediately prevent your participation in Games and/or notify the Trustee to prevent your making any withdrawals from or use of your account under the terms of the Trust Deed;
• iv. notify the Trustee that all winnings which have accrued and remain in your account or which are otherwise due to be credited to your account be released to us in accordance with the terms of the Trust Deed and to deal with them as directed by the relevant authorities;
• v. require you to pay to Betfair, or as Betfair so directs, any winnings already received by you and/or by anyone acting on your behalf; and
• vi. report you to the relevant authorities.

You understand that you may lose money when playing the Games and accept that you are fully responsible for any such loss. You accept that under no circumstances will any amounts lost by you be recoverable from us.

4. Your Representations

In consideration for us allowing you to play the Games, you represent to us (and acknowledge that we rely on these representations) as follows:

– Your participation in the Games is personal and not professional;

• i. You are solely responsible for recording, reporting, paying and accounting to any relevant governmental or taxation authority for any tax or other levy that may be payable on any winnings;

You will place all wagers on Games through the various user interfaces provided on our site and, other than any use of Betfair’s endorsed API service (which you may use to place bets within certain parameters on Betfair’s Exchange Games), you will not wager through other means, including the use of a “robot” player. Other than your permitted use of Betfair’s endorsed API service (referred to above), the use of programs designed to automatically place bets within certain parameters (i.e. “robot” players) is not permitted on any Games (including Poker, Casino, Arcade Games, Exchange Games, Bingo or any other Games) on any part of our site;
• vi. You will not choose a Games nickname and/or alias that is defamatory, offensive, pornographic or in any way intended to impersonate a real person or brand. Betfair reserves the right to amend your nickname and/or alias in its absolute discretion if it believes you have breached this representation;
• vii. You will not make offensive comments, use offensive or pornographic material or make potentially defamatory or inflammatory remarks in relation to any ‘chat’ or ‘forum’ facilities we provide and you accept that any postings made by you can be passed on to the relevant authorities should we deem this appropriate;
• viii. You will not disguise or interfere in any way with the IP address of the computer you are using to access the site or otherwise take steps to prevent us from correctly identifying the actual IP address of the computer you are using whilst accessing our site; and
• ix. You accept and agree to abide by the rules of the Games – as set out on our site – and any rules and terms for any promotions or loyalty schemes in which you participate, each as set out on our site from time to time.

5. Privacy

6. Cancellation, Termination, Suspension and Breach

We may restrict your access to our site, prohibit you from participating in any and/or all Games, freeze your chips, restrict seating and/or prohibit players from playing in a particular Game (including restricting two or more players from playing together at the same game), refuse or limit any wager you make, notify the Trustee to withhold payment of your winnings in accordance with the terms of the Trust Deed, suspend or terminate your account in our absolute discretion without cause at any time including, without limitation, if:

• i. there is a technological failure;
• ii. we believe that you have breached any of these Conditions;
• iii. you attempt to manipulate or ascertain information concerning the Software code or are involved in collusion;
• iv. you tamper or attempt to tamper with the Software in any way;
• v. you are committing any offence eg by attempting to access the Games from a jurisdiction where playing the Games is illegal;
• vi. you publish any actual or potentially defamatory, offensive, racist, harmful or obscene language or material; or
• vii. we suspect that you may be having difficulties obtaining credit.

Conditions relating to us

7. Changes to the Games

Betfair may, in its absolute discretion, alter or amend or withdraw any particular Game or any part thereof, and may add other Games at any time, and may alter prices, features, specifications, capabilities, functions and/or other characteristics of the Games at any time.

8. Matters beyond our reasonable control

We are not liable for any loss or damage that you may suffer in respect of an event of Force Majeure. For the purposes of these Conditions, “Force Majeure” means any event outside our reasonable control affecting our ability to perform any of our obligations under these Conditions.

9. Errors and Omissions

If there is any discrepancy between the gaming results on your computer and the results on our server, the results on our server shall be final and binding. If there is any discrepancy between your on-screen display and the balance in your account, the balance held on Betfair’s server is deemed to be the balance in your account and this determination shall be final and binding. You will forfeit any amounts shown to be in your account that result from human error or technical default.

If you are incorrectly awarded any winnings as a result of (a) any human error; (b) any bug, defect or error in the Software; or (c) the failure of the relevant Games product or the Software to operate in accordance with the rules of the relevant game, then Betfair will not be liable to pay you any such winnings and you agree to refund any such winnings that may have been paid to you as a result of such error or mistake.

Betfair and its respective licensees, distributors, parents, subsidiaries, affiliates and all of their officers and directors and employees will not be liable for any loss or damages which may be caused by the interception or misuse of any information transmitted over the Internet.

10. Indemnity

You agree to indemnify and hold us and our associated companies, affiliates, officers, directors, agents and employees harmless from any liabilities, claims, losses or demands made by any third party arising out of your breach of these Conditions or any of them (including documents incorporated by reference) or out of your violation of any law or the rights of any third party.

11. Limitation of liability

The Software is provided to you “as is”, without warranty of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, or non-infringement of third party rights. Betfair does not warrant that the operation of the Games or the Software will meet your requirements or be uninterrupted or error free or secure or that any defects are correctable or will be corrected. The entire risk as to the use, quality and performance of the Games and the Software lies with you. In addition, any security mechanisms included on our site or in the Software have inherent limitations, and you must determine that they meet your requirements.

Betfair’s maximum liability to you or any third party arising out of these Conditions or your use of our site or the Software, whether for breach of contract, equitable duty or in tort or otherwise, will be limited to whatever amount you paid to us whilst playing the Games. Nothing in these Conditions shall limit Betfair’s liability for death or personal injury caused by our negligence.

In no event will Betfair, its licensees, distributors, parents, subsidiaries, affiliates and all of its officers, directors and employees, nor anyone else involved in creating, producing or delivering the Games or the Software, be liable for any damages or losses whatsoever, including, without limitation, special, indirect, consequential, incidental or punitive damages, arising out of or in connection with these Conditions or the use or performance of the Games or the Software. this disclaimer and limitation applies regardless of the cause or nature of the losses or damages including, without limitation, lost revenue or profits (whether direct or indirect), interruptions, loss of data, inaccurate results, or delays, however arising and regardless of the theory of liability, even if Betfair received prior notice of the possibility of such damages.

Any allowable claim, if any, which you may bring against Betfair must be brought no later than sixty days after the date of the event giving rise to the claim, and you hereby waive any right to bring any claim not brought within such period.

If you are using any third party equipment, software or services (collectively, the “third party goods/services”) in connection with your use of our site or the Software, the entire risk as to the quality and performance of such third party goods/services rests with you. Should such third party goods/services prove defective, you assume the entire cost of all necessary repairs or corrections.

In no event will Betfair, its licensees, distributors, parents, subsidiaries, affiliates and all of its officers, directors and employees, nor anyone else involved in creating, producing or delivering the Games or the Software, be liable for any damages which may be caused by the interception or misuse of any information transmitted over the Internet Nothing in these Conditions shall limit or exclude liability for personal injury or death nor for representations made fraudulently.

12. Right of set off

We may at any time, without notice to you, notify the Trustee to set off any liability owed to us or to our customers by you, including (without limitation) in relation to any Betfair account in your name or which we believe to be under your control, against any funds held in another Betfair account in your name or which we believe to be under your control in accordance with the terms of the Trust Deed.

13. Intellectual property

The Sporting Exchange Limited (“TSEL”), part of the Betfair group of companies, is the owner of:

• a. all copyright and related rights in and to our site, including, without limitation, rights in databases;
• b. all trade mark rights, whether registered or unregistered, in and to BETFAIR and the BETFAIR logo;
• c. the domain name www.betfair.com which is our uniform resource locator (“URL”); and
• d. patents owned by the Betfair group of companies.

Any unauthorised use of any of these rights may result in prosecution or other action being taken against you.

You hereby assign to TSEL absolutely, any and all copyright and other intellectual property rights throughout the world in all media whether now known or hereafter developed, for the full period of copyright, including by way of present assignment of future copyright and all other rights whatsoever, in any bets, chat postings, game play or any other interaction made by you whilst playing the Games.

Conditions relating to other services

14. Information Services

From time to time Betfair may provide you with access to various information and content via our site (including micro-sites and video content), emails or any other means of communication. Further Betfair may provide you with links to third party websites which may include information.

This information is supplied “as is” and for guidance only. Use of such information is entirely at your own risk. To the fullest extent permitted by law, Betfair makes no representations or warranties of any kind, including but not limited to, the accuracy, quality or completeness of the information.

Betfair shall not be liable for any action taken by you as a result of your relying on any of this information or for any loss or damage suffered by you as a result of you using such information or any third party website linked to Betfair.

18. Dispute resolution

In the event of a dispute arising between us and you, we each agree to follow the procedure set out in our Dispute Resolution policy from time to time.

19. Amendments

23. Governing Law and Jurisdiction

Insofar as UK registered customers are concerned, this Agreement is governed by the laws of England. Insofar as non UK customers are concerned, this agreement is governed by the laws of Malta. By accepting these Conditions, you agree to submit to the exclusive jurisdiction of the location that Betfair determines in its sole discretion in respect of any disputes arising out of, or connected with, these Conditions. Nothing in this paragraph shall prevent Betfair from applying to the courts of any jurisdiction for such provisional or protective measures as are available under the laws of that jurisdiction.

These Conditions have been prepared in various languages other than English for reference only. In the event of any differences between the English version of these Conditions and any non-English versions, the English version shall prevail.

The rights and obligations under these Conditions shall not be governed by the United Nations Convention on Contracts for the International Sale of Goods and/or any local implementing legislation, the application of which is expressly excluded.

Conditions relating to “Return to Player” percentages

24. Return to Player percentages for certain Games offered by Betfair

This provision applies specifically to certain games which are tested by Betfair via the use of Random Number Generators (“RNGs”).

The Return To Player (“RTP”) percentage of a fixed odds game represents the theoretical payback of game over time expressed as a percentage of total amount staked. For certain games offered by Betfair, this theoretical payback percentage is verified by running a large number of transactions – typically in the range of 10 million – through the game to ensure that the expected payback is within an expected range of the theoretical RTP. For those games, the result is generated by an RNG, which guarantees that each game outcome is generated independently and entirely randomly.

Both the testing of the RTP and the RNG are completed by an independent, accredited testing house who perform certification testing on behalf of the appropriate licensing body for each game.

BETFAIR LIVE VIDEO IS NOT AVAILABLE TO AUSTRALASIAN CUSTOMERS

1. Access to Betfair Live Video

1.1 Betfair Live Video is only available to customers who have opened, and have a funded account with Betfair.

1.2 The territories to which we are able to stream events vary from sport to sport. The list of scheduled matches will reflect which events you can view from within your particular locale. 1.3 Betfair Live Video is currently free of charge for all content with the exception of certain horse racing and greyhound events(see below for further details).

2. Exchange – Horse Racing and Greyhounds

2.1 For UK, Irish, UAE, Latin American and Australian horse racing, a minimum matched bet of GBP2 (or currency equivalent) must be placed on the relevant “day of the race” market to qualify to watch that particular race.

2.2 For US and RSA horse racing, races are free to watch as long as you have a funded account.

2.3 For all greyhound races other than RPGTV races, a minimum matched bet of GBP2 (or currency equivalent) must be placed on the relevant ˜’day of the race’ market to qualify to watch that particular race.

For RPGTV greyhound races, races are free to watch as long as you have a funded account

2.4 Customers should be aware that SP bets with an odds limit set do not qualify as matched bets until the very start of race and they will therefore be unable to access the race stream until this time.

2.5 Antepost and Special bets do not qualify.

3. Tote GB – GB Racing

3.1 A minimum bet of GBP2 (or currency equivalent) must be placed on single leg pool bets (win/place, exacta, swinger, trifecta) in order to qualify to watch that particular race.

3.2 A minimum total stake of GBP2 (or currency equivalent) on Multileg pool bets (placepot, quadpot, jackpot and Scoop 6) will qualify to watch the relevant races associated with that pool bet.

4. Fixed Odds/Sportsbook – Horse Racing and Greyhounds

4.1 For UK, Irish, French, UAE, Mauritian, Latin American and Australian horse racing, a minimum total stake of EUR1.00 or GBP1.00 (or currency equivalent) must be placed in order to watch a single race. This can be in the form of a £/€ 1.00 single or £/€ 0.50 each-way bet.

4.2 The qualifying criteria for multi-leg bets are detailed in the table below:

In multi-leg bets the average stake per race must meet or exceed the minimum qualifying amount of EUR1.00 or GBP1.00 or currency equivalent, in line with the examples below:

• A GBP2 double would qualify you to watch both races. A GBP1.00 double would only qualify you to watch the first race by scheduled off time.
• A GBP0.40 Yankee would qualify you to watch all 4 races as the average stake per race is more than GBP1.00 – (GBP4.40 in total).
• A GBP6 8 fold accumulator would qualify you to watch the first 6 races, but not the 7th or 8th as the average stake per race is below the minimum unit amount of GBP1.00.
• Straight accumulators no longer qualify for live video after the point one leg is settled as a loser.

4.3 For US and RSA horse racing, races are free to watch as long as you have a funded account.

The precise length of the time delay will vary depending on a number of factors, but you should typically expect a time delay of between 2 and 5 seconds behind the actual event. The time delay may sometimes be significantly longer than this.

6. EXCLUSION OF LIABILITY

8. Intellectual Property Rights

8.2 You must not sell or make any charge for watching or using any part of Betfair Live Video, nor show any part of Betfair Live Video in public to an audience (even if no charge is made), nor authorise or assist any third party to do any of the same.

8.3 The content on Betfair Live Video is licensed to Betfair by third parties. The football, tennis, snooker, volleyball and basketball content on Betfair Live Video have been licensed by Perform Media Channels Limited.

9. General

9.1 Betfair reserve the right to change these terms and conditions at its discretion from time to time. If we make significant changes to these terms and conditions then we will take appropriate steps to bring such changes to your attention. It is your responsibility to check these terms and conditions from time to time to ensure that you agree with them and your continued use of Betfair Live Video will be deemed to be your acceptance of any changes to the terms and conditions.

9.2 These terms and conditions are governed by English law and any disputes will be dealt with by the English courts.

9.3 Betfair reserve the right to introduce other fees, subscriptions or charges or conditions for access to Betfair Live Video in the future. You will be made aware of the introduction of any charge or condition before it is introduced.

9.4 Betfair may refuse access to Betfair Live Video to any customer at its absolute discretion.

9.5 By accessing Betfair Live Video you accept these terms and conditions.

Part G – Standard Promotional Terms

These Standard Promotional Terms apply to all Betfair promotions and competitions. Except as expressly provided, in the event of any discrepancy or conflict between these Standard Promotional Terms and any specific promotional terms, then the specific promotional terms shall prevail.

1. Eligibility

1.1 You must be aged 18 years or more to participate in promotions and/or take part in competitions. It is an offence for anyone under the age of 18 to open an account or to gamble. Underage entries will be void.

1.2 All promotions are limited to one entry per customer. To ensure that the promotion is limited to one entry per customer, we only permit one customer to participate from each household address, IP address, email address, telephone number, same payment account (e.g. debit card, Neteller etc) or shared computer (e.g. public library or workplace).

1.3 None of the employees, nor any family members of employees, of Betfair and its affiliate companies, their agents, or those of their respective group companies may take part in prize draw promotions or competitions that involve any element of judgment by Betfair.

1.4 All promotions are available at the discretion of Betfair and Betfair reserves the right to restrict the availability of a promotion to any person. Any such restriction will not impact players who have already started wagering under a promotion.

1.5 If you have been sent an email excluding you from promotions you will not qualify any promotions. Please note that any such exclusion will not affect any free bet, bonus or other promotional offer you have already placed a qualifying bet towards. You will still receive the benefits of any promotion you have started qualifying for or already qualified for prior to this decision.

2. Fraud and Multiple Accounts

2.1 Fraudulent or multiple entries will not be accepted, neither will entries made in breach of these Standard Promotional Terms or the specific promotional terms.

2.2 Betfair reserves the right to exclude any entrant from competitions and/or promotions and from use of the Betfair website if Betfair believes that an entrant has tried to enter by using more than one username or is otherwise engaging in any fraudulent or illegal activity (including participation that would be in breach of the law in your local jurisdiction), whether or not that entrant would or might have won any prize but for such activity. Where multiple entries/accounts have been used, Betfair reserves the right to cancel these accounts and withhold payment of the prize/bonus or any other promotional benefits

3. Bonuses

3.1 Bonuses are awarded to enhance your enjoyment of our games however we reserve the right to govern how bonuses are used before a player is allowed to cash them in. As such we deem it necessary to restrict certain types of wagering from contributing to the wagering/turnover requirements.

3.2 Any bonus issued is valid for a period of 7 days from the date of issue unless otherwise stated in the specific promotion. Any remaining/unused bonus at the end of the stated period will be removed from the player’s account.

3.3 All bonuses credited must be “bought-in” to, accepted or declined. Once accepted, a bonus is credited to your playable balance. Declined bonuses will not be reapplied.

3.4 Wagering requirements for bonuses will apply to an account from the time a bonus is accepted and/or applied to an account.

3.5 When receiving a bonus, the player will first play with the money ‘bought-in’ to and only then will the player play with the bonus offered by the casino.

4. Irregular play

4.1 If Betfair becomes aware of a customer who, in the course of participating in a promotion or offer, has become able to guarantee wins and/or profits with no or only minimal risk, and/or benefits from a promotion or offer by participating through more than one Betfair account, and/or displays irregular or unusual playing or betting patterns which Betfair deems to be abusive, Betfair may elect to do any one or more of the following: (i) close the customer’s account(s); (ii) invalidate the transactions or game play which was in contravention of this term; and/or (iii) withhold the customer’s winnings from such transactions or game play.

4.2 Betfair reserves the right to withhold any withdrawals and/or confiscate all winnings for irregular play. Irregular play includes, but is not limited to, any one or more of the following types of play:

• a. Placing single bets equal to or in excess of 30% of the value of the bonus and deposit before the wagering requirements for that bonus have been met. For example, you deposit £100, accept a £100 bonus and place a single bet of £60 on any game.
• b. Moving from a low weighted game (25% or less) to a high weighted game (100%) after large wins for the purpose of clearing wagering requirements. For example, you place at least one bet on any game weighted at 25% or less, win 100% more than your stake and move your original stake and winnings to a game weighted at 100% in order to meet wagering requirements.
• c. Playing equal to or more than 500 auto spins on a Slot machine and/or playing a Slot machine consistently for a period longer than two hours while a bonus is active. For example, you set any game to run on auto spin for 500 spins while you have an active bonus in your account and/or you play for a period of two hours or more (irrelevant of how many sessions) while you have an active bonus.
• d. Low risk Roulette bets. ANY bet spread combination on Roulette games covering 25 or more (67%) of the 37 unique number spots on the table. For example, you bet on Red and Black, you are covering 36 of the 37 possible outcomes, therefore this bet would not count towards any wagering requirements.

5. Prizes

5.1 Prizes are not transferable or exchangeable other than at the sole discretion of Betfair.

5.2 Unless otherwise specified in writing, if you are required to travel as part of the promotion or as a competition prize winner, you are responsible for making all your own arrangements (including insurance).

5.3 We will attempt to contact all winning customers within 48 hours. If we cannot reach you within 48 hours, or if you do not claim your prize within 48 hours of being notified, we reserve the right to select a new winner.

6. Publicity

6.1 If you win a competition or a promotion, Betfair may ask you if you wish to take part in publicity. If you agree to take part, Betfair can make reasonable use of your name and image on the websites and in promotional materials.

7. Variation

7.1 Betfair reserves the right to amend any specific promotional terms, competition rules or these Standard Promotional Terms at any time. Any such change will not adversely impact players who have already started wagering under a promotion.

7.2 Betfair reserves the right to withdraw or vary the terms of competitions and promotions to comply with the decision of any relevant judicial or regulatory body and shall not be held liable to any entrant for so doing.

8. General

8.1 By entering the promotion or competition, you accept and agree to be bound by these Standard Promotional Terms and any specific terms and conditions relating to the relevant promotion.

8.2 Any disputes relating to promotions or competitions will be resolved in accordance with the Betfair Dispute Resolution Policy, see here.

8.3 Betfair accepts no responsibility whatsoever for system or connection problems that might affect any end user during any of these promotions.

8.4 Betfair and its affiliates and subsidiaries, or any of their employees, officers or directors shall not be liable for any loss, costs, expenses, damages, injury or other liability arising from a participant’s or winner’s participation in any competition or promotion, or for any such modification, alteration, discontinuance or termination of any competition, promotional or tournament. Nothing in this clause shall operate to limit or exclude liability for personal injury or death caused by our negligence.

8.5 Customers located in the UK agree that these Standard Promotional Terms shall be governed by and construed in accordance with the laws of England and Wales and you submit to the exclusive jurisdiction of the Courts of England. Customers located outside the UK agree these Standard Promotional Terms shall be governed by and construed in accordance with the laws of Malta and you submit to the exclusive jurisdiction of the Courts of Malta.

8.6 The Contracts (Rights of Third Parties) Act 1999 shall not apply to these terms and no rights or benefits expressly or impliedly conferred by it shall be enforceable under that Act against the parties to it by any other person.
